Justice Alexandre de Moraes stressed that certain usual rights of lawyers do not extend to Wassef in this context, mentioning: “In relation to Frederick Wassef … the conduct indicated as unlawful has no relation to the practice of law.”

Wassef will also not be informed in advance about when and where the seized items will be analyzed and will not have 24 hours to review the materials.

The restriction was defended by Moraes, who argued: “Giving the investigated person access to the evidence … would compromise the investigation, especially if new confidential actions were necessary, which depend on the secrecy of the investigated.”
